Description

9. THIRD RESOLUTION TO ACQUIRE AN ELEMENTARY SCHOOL SITE IN NORTH PORT
Description
On October 3, 2010, the Board approved the First Resolution, authorizing the acquisition of numerous small parcels for a future elementary school in North Port.  This Third Resolution approves the second batch of contracts for this acquisition.

Recommendation
That the School Board approve the Third Resolution of the School Board of Sarasota County, Florida, RE: Acquisition of Property for a Future Elementary School in North Port, Florida.

10. APPROVAL OF A NON-EXCLUSIVE UTILITY EASEMENT TO THE CITY OF SARASOTA FOR SANITARY SEWER LINES LOCATED IN THE 35TH STREET RIGHT OF WAY
Description
The rerouting of Orange Avenue for the Booker High rebuild project required that a portion of 35th Street be vacated by the City of Sarasota.  Once the street vacation is approved for 35th Street, the ownership of half of the right of way will revert to the School District.  The easement is for the sanitary sewer lines that will be located under the right of way for 35th Street that will be owned by the School District.

Recommendation
That the School Board approve the non-exclusive utility easement to the City of Sarasota for 35th Street right of way.

Description

12. APPROVAL OF TERMINATION OF AGREEMENT WITH ABACUS IN-HOME TUTORING, INC. SES TUTORING PROVIDER
Description
Abacus In-Home Tutoring, Inc. has voluntarily terminated its Title I SES contract with the Sarasota County School Board for SES tutoring for this school year.

Recommendation
That the School Board of Sarasota County approve the termination of the Abacus In-HomeTutoring, Inc. Title I SES contract with the School Board of Sarasota County.

EXPULSIONS

13. APPROVAL OF EXPULSION CASE NO. 11-127
Description

On October 12, 2010, the student listed in Expulsion Case No. 11-127, violated School Board, Policy 5.34(1)(d), Threat to Another Student.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 6, 2011.



Recommendation

That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-127, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2010-2011 academic year.

14. APPROVAL OF EXPULSION CASE NO. 11-200
Description

The student listed in expulsion Case No. 11-200, violated School Board Policy 5.32, Zero Tolerance, School board Policy 5.322, Against Use, Sale or Possession of Alcohol or Drugs, and School Board Policy 5.34(1)(d), Theft.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until January 14, 2012. 



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-200, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2010-2011 academic year, the 2011 summer session, until January 14 of the 2011-2012 academic year.

Description

The student listed in Expulsion Case No. 11-088, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On September 21, 2010, the student listed in Expulsion Case No. 11-088, violated School Board Policy 5.34(1)(d), Physical Aggression and Insubordination.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County School until October 12, 2011.

That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-088, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2010-2011 academic year, the 2011 summer session until October 12 of the 2011-2012 academic year.

Description
School Board Policy 5.34(4), permits and Board to hold in abeyance, the expulsion of a student, if the student participates in a recognized alternative-to-expulsion program.  This student is being placed at Venice High School.

23. APPROVAL TO AWARD BID #11-0016 FOR IRRIGATION INSTALLATION, MAINTENANCE AND REPAIR SERVICES
Description

Bids to provide 'Irrigation Installation, Maintenance, and Repair Services were received from six vendors on November 23, 2010.  The bids of Rainmaster, LLC dba Lang Irrigation for north county and mid county locations and Hazeltine Nurseries, Inc., for south county were the best low bids meeting the advertised specifications based on a sealed scenario.  Rainmaster, LLC dba Lang Irrigation had enough technicians to cover two areas.  This bid is for a period of one year with the option to renew for two additional one-year periods.  The funds for these purchases are contained in the capital budget allocated to the Facilities Services Department.



Recommendation
That the bids of Rainmaster, LLC dba Lang Irrigation for north county and mid county locations and Hazeltine Nurseries, Inc., for south county, to provide 'Irrigation Installation, Maintenance, and Repair Services' in an amount not to exceed $200,000.00, be approved for award and purchase.

24. APPROVAL TO AWARD BID #11-0037 FOR SCTI COSMETOLOGY FURNITURE AND EQUIPMENT
Description
Bids to provide 'SCTI Cosmetology Furniture and Equipment' were received from five vendors on December 7, 2010.  The bids of AB Salon Equipment and Evolution were the best low bids meeting the advertised specifications.  Justifications for not selecting the apparent low bid are included with the bid tabulation.  This bid is for a period of one year with the option to renew for two additional one-year periods.  The funds for these purchases are contained in the capital budget allocated for the project.

Recommendation
That the bids of AB Salon Equipment and Evolution, to provide 'SCTI Cosmetology Furniture and Equipment' in the amount of $82,181.61, be approved for award and purchase.

Recommendation
That the bids of A. CONSTRUCTION

28. APPROVAL OF AMENDMENT #2 TO ARCHITECT'S CONTRACT FOR THE VENICE HIGH SCHOOL RE-BUILD PROJECT
Description

The scope of work for this amendment is to add the Civil Design services to delete a lift station currently located at the ball fields and replace it with gravity sewer.



Recommendation
That Amendment #2 to the Agreement dated January 4, 2011 with Schenkel Shultz, Inc., for the Venice High School Re-Build project be approved as presented.

29. APPROVAL OF ANNUAL CERTIFICATION OF PROFESSIONALS FOR CONSTRUCTION RELATED SERVICES
Description

The recommended professionals have submitted request for annual certification by the School Board to provide professional construction related services for Sarasota County School Board projects.  These submissions are in accordance with School Board Policy, 7.71.



Recommendation
That the Annual Certification of Professionals for Construction Related Services be approved as presented.

30. APPROVAL OF ARCHITECT'S CONTRACT FOR THE SARASOTA MIDDLE SCHOOL RENOVATION PROJECT
Description

The scope of work shall include design and construction administration services to renovate the HVAC systems including new chiller(s) and pumps, thermal energy storage system, piping, air side systems, and electrical distribution system at the referenced campus.  Also included is the sealing of the perimeter of the attic space with an air barrier to create a non-ventilated attic, paint, carpet and paving.  On December 8, 2010, the Director of Construction Services met with a representative of TOTeMS Architecture, Inc., and successfully negotiated a contract.  The amount of this contract is $629,750.00.  These contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The project budget for the entire renovation is $10,000,000.00; $2,000,000.00 is available in the current FY budget account for the replacement of the chiller plant.

 



Recommendation

That the architect's contract for Sarasota Middle School Renovation project be approved as presented.



31. APPROVAL OF CONSTRUCTION MANAGER RANKINGS FOR THE LAUREL NOKOMIS SCHOOL RENOVATION PROJECT
Description
The scope of work shall include construction management services to renovate the HVAC systems including new chiller(s) and pumps, thermal energy system, piping, air side systems, and electrical distribution system at the referenced campus.  Also included is the sealing of the perimeter of the attic space with an air barrier to create a non-ventilated attic, paint, carpet and paving.  On 12/7/10, the Professional Services Selection Committee (PSSC) met to select a construction manager.  The PSSC has ranked them in accordance with Board policy.  The project budget is approximately $10,000,000.00.  Funds for this project are available in the capital budget account.

Recommendation

That the rankings of construction managers for the Laurel Nokomis Renovation project be accepted as presented and the Director of Construction Services be authorized to attempt negotiations with the top-ranked firm.

33. APPROVAL OF CONTRACT FOR CONSTRUCTION FOR THE BOOKER HIGH SCHOOL REBUILD PROJECT: PHASE II - DEMOLITION & SITEWORK - UTILITY RELOCATION
Description

Under the terms of the 11/17/2009 (Item#30) Board approved "CONSTRUCTION MANAGER'S PRECONSTRUCTION SERVICES CONTRACT FOR THE BOOKER HIGH SCHOOL - REBUILD PROJECT", the Director of Construction Services and a member of the Professional Services Selection Committee (PSSC) have successfully negotiated a contract with Willis A. Smith, Inc. for a portion of the Booker High School Rebuild Project.  The 11/17/2009 agreement included pre-construction and bidding services only.  The scope of this contract shall include construction management services necessary to complete demolition, site development, and utility relocation for the Booker High School Rebuild Demolition and Site Work Phase according to DMK Associates and Harvard Jolly Architects plans dated November 12, 2010.  The Guaranteed Maximum Price (GMP) of this contract is $5,042,533.00.  The remaining contracts for construction will be negotiated upon completion of those Contract Documents.  This contract is available for review at the Construction Services Department.  The School Board attorney has approved the use of this contract.  Funds for this contract are available in the project budget account.



Recommendation
That the Contract for Construction for the Booker High School Rebuild Project:  Phase II - Demolition & Sitework - Utility Relocation be approved as presented.

34. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES' CHANGE ORDER(S)
Description

The Construction Services' Change Order(s) are summarized on the enclosure for ease of review.  These change orders collectively total a decrease of $5,021,900.27 in contract amounts.

FINANCE

35. APPROVAL OF AN INVESTMENT ADVISORY AGREEMENT BETWEEN PUBLIC FINANCIAL MANAGEMENT (PFM) AND THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA
Description
This agreement will provide the District with professional managed investment services by PFM for its idle funds.  In particular, the proceeds from the Qualified School Construction Bonds Series 2010A Certificates of Participation and the Series 2010B Certifications of Participation issues for the rebuilds of Booker and Venice High School.  PFM will invest the proceeds to maximize the District's return until the funds are needed for construction.  This agreement is a piggyback of the agreement currently in force between PFM and the School Board of Marion County, Florida.

Recommendation
That the investment advisory services agreement between Public Financial Management and the School Board of Sarasota County, Florida, be approved.
